<p>We want you to be pleased with the goods that you purchase and with the service that you receive from us. These are Cerami conditions of sale that apply to you order and you should read them carefully.</p>
<p>1. Introduction</p>
<p>1.1 The supplier of the goods under your order is Tarelka Ltd whose registered office is at 65 Castletown Road, London, W14 9HG (company number 10982673). Cerami or Cerami.co.uk is Tarelka Ltd’s trademarks.</p>
<p>1.2 When you order goods from us a contract will be formed when you receive a copy of your email order confirmation.</p>
<p>1.3 If you want to change your order (including the arrangements for delivery or collection), you must contact us immediately as any changes may delay the delivery of your order. To cancel your order or any part, please see section 4 below 'Cancelling your order'.</p>
<p>1.4 If you purchase the same goods under two or more orders, we cannot guarantee that the goods supplied will be from the same batch and be an exact colour match.</p>

<p>2. Your information</p>
<p>2.1 You guarantee that when you register with us as a customer all of the information which you provide is true, accurate and up to date.</p>
<p>2.3 You must not impersonate any other person or entity or use a false name or a name which you do not have authority to use. You must not use the website in any way which will cause or is likely to cause the website to be impaired, damaged or interrupted in any way.</p>

<p>3. Price and payment</p>
<p>3.1 The price for the goods (including any applicable delivery charges) is as set out in the order confirmation. Extra delivery charges may apply – see section 6 'Extra delivery charges'.</p>
<p>3.2 You must pay in full for the goods (including any applicable delivery charges) at the time of placing your order.</p>
<p>3.3 Ownership in the goods we supply to you will not pass until we have received all sums due and payable by you for or in connection with the goods, including (where applicable) delivery charges.</p>

<p>4. Cancelling your order</p>
<p>4.1 Cerami is under a legal duty to supply goods that conform to the contract. Where goods are not as shown on the Website − then please see section 9 'Quality of your goods‘.</p>
<p>4.2 Where you have ordered your goods with us via internet, under the Consumer Contract (Information Cancellation and Additional Charges) Regulations you may cancel your order at any time between placing the order and within 14 days after the goods come into your possession (or the last item of a multiple order comes into your possession).</p>
<p>4.3 To cancel the order email us at customerservice@cerami.co.uk, message us on Instagram (cerami_dinnerware) or call on 07900405475 referencing your order number.</p>
<p>4.4 Please take a good care of the goods in your possession, we are entitled to deduct an amount from the refund to reflect any loss in value of the goods supplied, if the loss is the result of poor handling of the goods by you.</p>
<p>4.5 Please make it clear when you cancel that you are cancelling under the Consumer Contracts (Information, Cancellation &amp; Additional Charges) Regulations.</p>
<p>4.6 Cancellation must be by the person who placed the order. If you cancel by telephone, we will need to be satisfied that you are the person who placed the order. We might ask you additional questions to establish this.</p>

<p>5. Delivery of goods</p>
<p>5.1 We employ different delivery companies to deliver our goods depending on what type of goods you are ordering and your delivery address.</p>
<p>5.2 Standard Delivery (UK) for us is the 2nd day delivery from the day of placing the order. Delivery cost is £6.75 per delivery. Delivery at this rate is only available to mainland UK. Most deliveries are made Monday to Friday between 8am − 6pm.</p>
<p>5.3 All Dinner Sets and orders above £100 are delivered free of charge in the UK mainland only.</p>
<p>Whilst we deliver to most areas in the UK, we are unable to guarantee delivery, within our usual lead times, to certain areas. These include Highlands &amp; Islands, Channel Islands (excluding Guernsey), Isles of Scilly and the Isle of Man.</p>
<p>5.4 Delivery is also available to the EU countries. Delivery cost is £25.00 per delivery. Please note, all Dinner Sets and orders above £100 delivered to the EU countries are subject to the same £25.00 fee per delivery.</p>
<p>5.5 We can also deliver goods to non-EU countries. Please contact us at customerservice@cerami.co.uk, message us on Instagram (cerami_dinnerware) or call on 07900405475 to obtain availability of the service and delivery rates.</p>
<p>5.6 Delivery outside of the mainland UK is subject to the availability of our couriers’ service in the area and can not be guaranteed.</p>

<p>6. Extra delivery charges</p>
<p>6.1 Extra charges for delivery may apply in any of the following circumstances:</p>
<p>6.2 If you change the address where your goods are to be delivered at short notice.</p>
<p>6.3 If delivery is costlier and/or takes longer than it otherwise would have because of any special factors that you failed to tell us about.</p>
<p>6.4 If the goods need to be redelivered because there was no-one at the delivery address aged 18 or over to sign for the goods at the time arranged for delivery.</p>
<p>6.5 If you need to inform us of any special factors regarding your delivery after you have placed and confirmed your order please email us at customerservice@cerami.co.uk, message us on Instagram (cerami_dinnerware) or call on 07900405475.</p>
<p>6.6 For our standard delivery items, you will receive a text message the evening before to confirm your parcel is arriving (as long as you have given your mobile phone number). If you are not available, the driver will try to locate a safe location where the parcel can be left. If they are unable to find a suitable and safe location, a card will be left with instructions on arranging redelivery. If delivery cannot be made within 5 days of receiving the card, the item will be returned back to us and a re-delivery fee will apply.</p>
<p>6.7 If you cancel the order after the 1st delivery attempt and before the re-delivery, the delivery charges will not be refunded or in case of the free delivery the delivery charges will be deducted from your refund.</p>
<p>6.8 We will let you know if any extra delivery charges are payable and you must pay these charges before delivery or re-delivery (as appropriate) or, if charged after delivery, within 7 days of receiving notice of such extra delivery charges.</p>
<p>6.9 If delivery proves impossible or impractical on 2 or more occasions because of access problems or because there was no-one at the delivery address aged 18 or over to sign for the goods at the time arranged for delivery, then we may cancel your order and deduct delivery charges from your refund.</p>

<p>7. Delay in delivery</p>
<p>7.1 Occasionally the delivery of your goods may be delayed by circumstances outside our control. If for any reason we are unable to deliver the goods or to have them ready for collection within the original approximate timeframe then we will notify you of the delay and new timeframe as soon as possible.</p>
<p>7.2 If you cannot wait for the goods, you must let us have notice of cancellation from the person who placed the order. If we receive your notice of cancellation as set out above, then you will receive a full refund.</p>

However, Tarelka Ltd will not accept any liability for any losses incurred or for compensation for perceived inconvenience that may be suffered due to any delay.</p>

<p>8. Arrival of your goods</p>
<p>8.1 On delivery of your goods you need to inspect the goods as soon as possible. Please note: we will only refund/ exchange broken items if you send us a picture of the broken item(s) as a proof to customerservice@cerami.co.uk on to 07900405475 at the day of the delivery.</p>

<p>9. Quality of our goods</p>
<p>9.1 Please notify us of obvious defects that are apparent on first inspection of the goods, such as missing parts or damage, within 7 working days of delivery. You may notify us by e-mail to customerservice@cerami.co.uk, message us on Instagram (cerami_dinnerware) or call on 07900405475.</p>
<p>9.2 Your statutory rights, in particular your rights under the Consumer Contract (Information, Cancellation and Additional Charges Regulations, and Sale of Goods Act) are not affected.</p>
<p>9.3 You agree that we may examine any goods that are claimed to be defective to establish whether those defects are our responsibility. We will either arrange a video call to inspect it remotely or collect the goods from you for that purpose.</p>
<p>9.4 When we are satisfied that the goods are faulty, we will send you a replacement of the defective goods. We might also collect the defective goods from you (on our discretion). Please also note that you may have to wait for replacement goods as they can be out of stock. If we cannot replace the goods within 2 weeks, we will refund you the cost of the defective items. Please note, if the item is part of a set, we will refund you pro rata based on the number of items in the set.</p>
<p>9.5 Please note: due to the nature of the ceramic creation process, colour, glaze and shape variations may occur as stated on each individual product page, and these variations won’t be regarded by us as faulty or damaged goods.</p>
<p>9.6 Nothing in this section affects your statutory rights as a consumer.</p>

<p>10. Changes to your order</p>
<p>10.1 Once you have received confirmation of your order, changes can only be made to your personal details up to the point of your delivery being booked with you.</p>
<p>10.2 If you wish to make changes to the items ordered, your order will need to be cancelled and a new order placed.</p>

<p>10.4 Changes made to your order after the original confirmation will result in a new approximate time frame for delivery.</p>

<p>11. Refunds</p>
<p>11.1 To obtain a refund you must take reasonable care of the goods. If you fail to do so we reserve the right to refuse the refund or deduct a charge based on the condition of the goods.</p>
<p>11.2 Until the goods are returned to us, you are responsible if the goods are lost, damaged or destroyed. Shipping of the goods back to us is also under your responsibility, so please make sure that you package goods with great care. You have a legal obligation to take reasonable care of the goods while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.</p>

<p>11.4 Under your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations, you can cancel the order and return the goods back to us within 14 days after receiving your order. The full refund will be given back to you once we receive them safely back. If you have paid for delivery originally then we will refund the original delivery charge for unwanted goods if all the goods purchased on the order are returned. Part returns do not qualify for a delivery refund.</p>
<p>11.5 If your item was delivered to a home address, we will make arrangements for the goods to be collected from you. Please note this will incur a lead-time. The collection charge will apply at our Standard Rates:</p>
<p>-UK mainland: £7.80 for diner sets and all orders above £100, and £6.75 for all other orders</p>
<p>-EU countries: £25 for all orders</p>
<p>-International: subject to courier charges</p>
<p>11.6 Your refund will be processed as soon as possible and in any event within no more than 28 days of the day you have given us notice of cancellation. We will deduct the collection fee from the refund amount.</p>
<p>11.7 We will only make a refund using the same method of payment originally used by you to pay for your purchase.</p>
<p>11.8 Where the goods were delivered to a third party and you are unable to return them to us, you may not be entitled to a refund.</p>
<p>11.9 You won’t be able to return the goods after 14 days of the goods receipt.</p>

<p>12. Our products</p>
<p>12.1 All goods are subject to availability. If for any reason beyond our control, we are unable to supply any goods then you will be offered a full refund.</p>
<p>12.2 To get the most out of any goods, you should take care to follow the care instructions. The goods we sell are for consumers for general domestic use only and must be used for the intended purpose.</p>

<p>13.1 By using the Cerami website, you consent to the use of cookies and similar technologies by us.</p>
<p>13.2 Your privacy is very important to us and we are committed to treating your personal data (e.g. your name, telephone number, e-mail address, billing and delivery address, debit and credit card details) with total respect and confidentiality.</p>

<p>14. General legal</p>
<p>14.1 We will not be responsible for any delay in complying or failure to comply with our obligations under these conditions of sale if that delay or failure is due to any circumstances outside our reasonable control including without limitation fire, flood, acts of terrorism or where we are let down by a supplier.</p>
<p>14.2 These conditions of sale are in addition to, and do not affect, your statutory rights as a consumer. They are the only terms and conditions that are applicable to your order.</p>
<p>14.3 You may not transfer your rights under the contract between us to any third party without Cerami's prior written consent.</p>
<p>14.4 If any term of these conditions of sale is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, then such term will be severed from the remaining terms which will continue to be valid to the fullest extent permitted by law.</p>
<p>14.5 If you do not comply with these conditions of sale and we take no action in respect of that non-compliance, our right to take action in the same or a similar situation in the future will not be affected.</p>

<p>14.7 These Conditions of Sale and any contract formed in accordance with clause 1 of those Conditions are governed by and construed in accordance with English Law and will be subject to the exclusive jurisdiction of the courts of England and Wales.</p>
<p>14.8 When we refer to "you" and "your" we mean the user of the Website and purchaser of Goods.</p>
<p>14.9 By using this Website you consent to the processing described therein and warrant that all data provided by you is accurate.</p>
<p>14.10 You must not misuse this Website. You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. Tarelka Ltd will report any such breach to the relevant law enforcement authorities and disclose your identity to them.</p>
<p>14.11 You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by Tarelka Ltd.</p>

We will try to resolve all information errors on the Website as soon as reasonably possible, and if we reasonably think that such an error has affected your purchase of Goods we will try to let you know. However, because we take these steps we will not be liable to you for any errors on the Website.</p>

<p>15. Promotions</p>
<p>15.1 Promotional Codes may be redeemed for goods on our website www.cerami.co.uk. Promotional Codes will only be redeemed where a valid is used at the online checkout at the point of sale. Tarelka Ltd reserves the right to reject illegible or incomplete Promotional Codes.</p>
<p>15.2 The expiry date of a Promotional Code you can find in the same email that contains the code or can be checked at any time by contacting us at customerservice@cerami.co.uk, message us on Instagram (cerami_dinnerware) or call on 07900405475.</p>
<p>15.3 Promotional Codes have specific conditions when they can be redeemed, and they cannot be exchanged for cash or other Promotional Codes and are not for resale.</p>
<p>15.4 Tarelka Ltd is not responsible for any lost, stolen, undeliverable or delayed Promotional Codes or any network failures. If you are the purchaser, please double check the delivery email address that you enter – it is your responsibility to do so and we can’t be held responsible if a Promotional Code is used by someone other than your recipient if any details are entered is incorrectly. In addition, we can’t take responsibility for any Promotional Codes that are lost or used by someone other than yourself.</p>

<p>For the UK mainland delivery, you will receive the goods the next day after they’ve been dispatched.​</p>
<p>European Union deliveries will arrive within approximately a week.​</p>
